Terms and Conditions of Inspection Service - CarTech

Dear Customer,

Upon your arrival at the CarTech center and payment of the vehicle inspection fee (car), you agree to the terms and conditions of this agreement. These terms are an integral part of the system and policy of CarTech Vehicle Services Company (CarTech), available on our website www.cartech.com.sa or www.cartech-markets.com.

Definitions

  • Inspection Service: The vehicle inspection service we provide, CarTech, referred to here as "the First Party" or "the Inspector."
  • Customer: The client requesting the inspection service or any other service, referred to here as "the Second Party" or "the Customer."



First: General Terms

1. Payment of the Agreed Amount:

The Second Party must pay the agreed-upon amount for the complete vehicle inspection before the Inspector begins the inspection. The inspection will not commence until payment receipt is confirmed.

2. Invoice:

The inspection invoice includes the vehicle and customer data, correctly and completely requested by the service requester, and is considered an official document for payment. The First Party has the right to request the invoice if the inspection is not completed.

3. Responsibility for Inspection Request:

Requesting a vehicle inspection is the responsibility of the Customer and is considered implicit consent from the vehicle owner if the owner is not disclosed at the time of inspection. A technician must accompany the Customer during the field inspection.

4. Summary Service:

The service of inquiring about the vehicle's record (summary) is optional for the Customer and is considered an integral part of the inspection. CarTech is not responsible for any information that appears later or appears in the summary service.

5. Inspection Reports:

The Customer agrees to accept all reports issued by the First Party. CarTech is not responsible for any inaccurate information provided by the Customer or any latent defects that did not appear at the time of inspection. The Customer is responsible for disclosing any modifications or improvements made to the vehicle.

6. Vehicle Condition:

If the Inspector deems the vehicle unsafe or unfit for driving due to a malfunction or unsuitable weather conditions, the inspection will be postponed until the issue is resolved.

7. Report Approval:

The inspection report is only considered approved if it is stamped with an authorized CarTech seal or sent through CarTech's official systems. Otherwise, the report is deemed null and void and not approved.

8. Re-inspection:

If re-inspection is not conducted within the specified period, the inspection is considered null and void and not approved.

9. Electronic Inspection Limitations:

Electronic inspection devices or inspectors cannot display the engine bearings' pressure percentage, diagnose airbags if resistors are installed or replaced with new ones, or show codes that have been erased or programmed to be invisible. Additionally, devices cannot detect the odometer if it has been rolled back or tampered with. Therefore, these matters are outside the scope of inspection using electronic devices, which are limited to aspects that the devices can detect only.

10. Replaced Spare Parts:

Any part that has been replaced or a defect that has been repaired and not detected by the used inspection devices is not CarTech's responsibility.

11. Vehicle Status:

CarTech is not responsible for the vehicle's condition before or after the inspection date.


The customer explicitly agrees, acknowledges, and permits the first party, CarTech, that upon the entry of their vehicle into the CarTech center, they consent to allowing their vehicle to be photographed in all its parts and reviewed, whether through photographic images or detailed video recordings. CarTech is authorized to publish these materials on any platform or location it deems appropriate. The customer may appear in the recordings if present, and the materials may be used for media or educational purposes. These materials may be published, printed, or displayed through all visual, audio, or written media, on websites, or on other social media platforms.

I also declare that CarTech may use these images without any financial compensation, and full ownership of the materials belongs solely to CarTech, without any liability, complaint, or claim against CarTech.


Second: Inspection Service

1. Service Description:

The inspection service aims to identify visible defects in the vehicle during the inspection process only. This service does not include predicting future malfunctions or those that require specific conditions to appear.

2. Limitations of Liability:

o Disassembled Parts:

Any part of the vehicle showing signs of disassembly or tightening is recorded in the inspection report as is, without speculating or interpreting the reason for disassembly or tightening.

o Wear and Insulation:

Wear or insulation spray cannot be detected through visual inspection alone. Therefore, these matters are outside the scope of the inspection report, and CarTech disclaims any responsibility for them.

o Invisible Parts:

The inspection does not include parts or components that cannot be seen or accessed except by disassembling parts of the vehicle.

o Aesthetic Aspects:

The inspection does not include evaluating the vehicle's aesthetic appearance and does not cover inspecting internal and external fixtures or essential accessories unless an accessory inspection package (comprehensive inspection) is selected.

o Exceptional Malfunctions:

Malfunctions that appear only under certain conditions, require disassembly of parts, or have been deliberately concealed are not covered by the inspection.

o Sequential Electronic Malfunctions:

The inspection does not cover electronic malfunctions that only appear after repairing another part causing the primary issue.

o Malfunctions During Inspection:

The First Party is not responsible for any malfunctions or problems resulting from the vehicle's poor condition or that occur during the inspection process.

o Chassis Technical Inspection Limitations:

Modifications, cutting, or welding on the chassis covered with insulation, paint, or putty cannot be detected. Although the technician will do their best to discover any modifications or damage to the chassis, it may require removing insulation, paint, or putty to ensure an accurate assessment of the chassis condition. Therefore, to conduct a comprehensive and accurate evaluation, these materials that may affect detection ability must be removed.

o Implementation of Recommendations:

The First Party is not obligated by the Customer's failure to implement the observations recorded in the report and is not responsible for any errors or problems resulting from manufacturing defects.

o Fiberglass and Glass:

The inspection does not cover the evaluation of fiberglass or glass.

Field Inspection:

The client acknowledges, undertakes, and agrees that if the vehicle is included in the field inspection according to the policies, terms, packages, and service provided, CarTech (the First Party) is not responsible in any way for any accompanying person during the field inspection with the CarTech technician. Whether the client accompanies the technician as a buyer or seller, or if a third party accompanies them, or if all parties accompany the technician, this is outside CarTech’s responsibility, and CarTech fully disclaims any responsibility. CarTech sends the technician for the field inspection without requiring any accompanying party, and anyone who wishes to accompany the technician is welcome to do so, but it is neither necessary nor mandatory for CarTech to provide an accompanying party. The arrangement for any accompanying person is solely between the buyer, seller, or other parties, with no technical, regulatory, or legal responsibility on CarTech.

MOJAZ Service:

The client understands, acknowledges, and undertakes that when requesting the MOJAZ service, CarTech holds no responsibility for the MOJAZ report or any information or data it contains. The MOJAZ report is generated solely based on the serial number provided by the client, and CarTech has no involvement or responsibility whatsoever for any of the report's contents or any errors in the serial number provided by the client or the vehicle information. This service is offered only upon the client's request and upon providing the vehicle's serial number, with no responsibility on CarTech regarding the report contents or vehicle information. CarTech fully disclaims any technical, legal, or other liabilities.


Third: Inspection Warranty

1. Inspection Warranty Coverage:

CarTech's warranty is limited to the items and parts inspected and passed according to CarTech's terms and conditions. This warranty is valid for 30 days from the inspection date or 1,000 kilometers, whichever comes first. The center's liability covers an amount not exceeding 15,000 in case of a proven error in the inspection process. Repairs are conducted at one of CarTech Warranty Company's (Himaya) authorized branches according to CarTech Warranty's terms and conditions. The warranty does not cover parts not inspected, spare parts, consumable materials, or defects resulting from Customer misuse. Any modifications made after the inspection or before presenting the vehicle for inspection and not reported absolve CarTech of all responsibility.

2. Standard Defects:

Defects clearly identified during the inspection and documented in the final report.

3. Non-Standard Defects:

Defects that only appear after the vehicle is subjected to additional stress or under certain conditions not covered by the warranty are entirely excluded. The warranty does not cover defects that may appear after the inspection at speeds exceeding 80 km/h, as it is impossible to exceed this speed during the field test according to traffic system speed limits. The warranty also does not cover any defects requiring disassembly of the vehicle to access them or defects arising from parts not inspected or not within the inspection scope, as well as plastic parts or those made of rubber, or those with metal or plastic locks due to sudden and rapid condition changes such as water, fuel, oil, or refrigerant leaks.

4. Warranty Exclusions:

The warranty does not include:

o Uninspected Parts:

Any part of the vehicle not included in the detailed inspection or not mentioned in the report.

o Post-Inspection Modifications:

Any modification made after the inspection or made before the inspection and not reported.

o Wear and Rust:

Any wear, rust, or insulation spray not visible during the visual inspection and cannot be detected without disassembly.

o Undisclosed Defects:

Any defects that existed before the inspection and were not detected or disclosed by the Second Party or vehicle owner intentionally or unintentionally.

o Weather and External Conditions or Recorded Flooding, Damage, or Fire on Systems:

Any damage discovered after the inspection.

5. Limitations of Liability:

The First Party is not liable for any defects or problems not discovered or predicted during the inspection. All results mentioned in the report are considered final and cannot be requested for modification, nor can the Customer object to them after the warranty period has expired.

6. Parts Covered by Warranty:

o Engine:

Includes rocking parts and joints, blow hoses (air and fire), blow hose skins, drive arms, camshaft, gears and chains, oil pump, bearings, crankshaft seats, column seats, multiple intake valves.

o Gearbox:

Includes gears, synchronized clutch shafts, filters, lining shafts, speed transmission gears, belts, bearings, clutches, body bellows, oil pump, boost system, motion transmission gears, and torque converter.

o Differential:

Includes the axle, pinion gears, and the internal gear set with the pinion and gears.

o Steering System:

Includes the upper and lower steering box.

o Engine Cooling System:

Includes the radiator, fan mount, and oil cooler.



Fourth: Inspection Cancellation Instructions

  • Inspection Cancellation:
  • In case of inspection cancellation at any stage, the amounts paid for the services already performed or not yet performed are non-refundable. The amounts paid for the provided services are non-refundable if the service is canceled after it has started or during its execution.
  • Specified Defects:
  • Defects in specific parts of the vehicle may appear during the inspection, forming part of the decision-making process for purchasing the vehicle. The partial or final report represents the vehicle's condition based on the conducted inspection and is part of the effort to provide an accurate and comprehensive inspection service.
  • Terms and Conditions:
  • The Customer acknowledges and agrees that all results obtained through the inspection are final. The Customer is not entitled to request a refund for amounts related to stages that have not been inspected or conducted yet.



Complaint Procedure

1. Submitting a Complaint:

A written complaint must be submitted by the Customer or their representative, provided the vehicle is under their ownership, to the Technical Management Department of the company. The complaint must include all relevant details, documents, and evidence related to the objection.

2. Complaint Review and Response:

The Technical Management of the First Party will review the complaint and investigate its details. The Customer will be responded to within 14 working days from the date of receipt of the complaint. The response will include an explanation of the actions taken or any results related to the submitted complaint. The company reserves the right not to respond if the warranty has expired.

3. Non-implementation of Repairs:

The Customer is not allowed to repair or modify any of the malfunctions or problems reported in the complaint before consulting the company and receiving an official response. Any unauthorized repairs or modifications will lead to the complete exclusion of the warranty and the First Party's liability.



Alerts

1. Transaction Suspension or Cancellation:

The First Party has the right to suspend or cancel any transaction or vehicle inspection for the Second Party in case of violation of the center's rules and instructions.

2. Personal Property Loss:

The First Party is not responsible for the loss of personal belongings inside the vehicle. The Customer must remove all personal belongings from the vehicle.

3. Governing Laws:

The provisions of this agreement are subject to the applicable laws, regulations, and instructions in the Kingdom of Saudi Arabia. In case of a dispute between the parties, they have the right to refer to the competent authorities.



Policy for Purchasing Electronic Vehicle Inspection Reports from Auctions, Exhibitions, or the Website

This policy is an integral part of CarTech Inspection Services' terms and conditions.

1. Provision of Reports:

We provide inspection reports for auction or exhibition vehicles based on inspections conducted on vehicles displayed at the auction or exhibition. The reports include information about the vehicle's condition, such as:

o Engine and Gearbox Binding Condition:

The inspection verifies the binding only without delving into the engine or gearbox performance or maintenance needs.

o Chassis Cutting:

The inspection ensures the presence of any cutting on the chassis, focusing only on cutting operations and does not include inspecting any modifications, welding, or other works.

o Body Spray:

The inspection involves identifying only the areas sprayed on the vehicle's external structure and does not include dents, scratches, or bulges that were not sprayed.

o Government or Company Logos:

In some vehicles, there may be government or company logos. It is important to clarify that we cannot predict what spray work or modifications may exist under these logos. The inspection does not include removing logos to verify the basic condition of the paint or structure beneath them.

o Engine and Gearbox Condition:

The inspection focuses on determining whether the engine and gearbox are functioning or not. It does not include assessing engine or gearbox performance, fuel consumption efficiency, maintenance needs, or any other malfunctions.

o Inspection Limitations:

The inspection is limited to the engine's or gearbox's ability to function only, without any additional evaluation of their condition or performance.

2. Warranty:

Your inspection includes a warranty period of 30 days or 1,000 kilometers, whichever comes first, covering the inspection of the following parts: disassembly of the transmission (gearbox) or engine, chassis cutting, and body spray. The center's liability in case of an inspection error does not exceed 15,000 for the entire vehicle, provided that the repair is carried out at one of the branches authorized by the CarTech Warranty Company (Himaya) within the mentioned amount according to the warranty company's terms and conditions. The warranty does not include parts and consumable materials used in any case, or defects resulting from Customer misuse. The warranty conditions outlined in Clause Three of the Inspection Warranty apply.

For cases of flooding, fires, or damage, if any, the Customer can purchase a summary report containing this information, which has been collected from reliable sources, via the provided link.

3. Parts Outside Warranty:

All terms and conditions in Clause Three of the Inspection Warranty apply.

o Uninspected Parts:

All parts not inspected and mentioned in the report are outside the warranty and inspection.

o Chassis Modifications:

Any modification or welding on the chassis that does not include cutting is outside the warranty and inspection.

o Body Modifications:

Any modification to the body, whether resulting from an accident or other works, and not involving spraying, is outside the warranty and inspection.

o Engine Defects:

Defects in the engine such as noise, vaporization, increased consumption, overheating, or mixing water with oil are outside the warranty and inspection.

4. Responsibility for Purchasing Electronic Reports:

When purchasing reports, full responsibility lies with the buyer. The buyer must ensure that the vehicle is still under auction or available at the exhibition before completing the report purchase.

5. Report Accuracy:

We commit to providing accurate and comprehensive reports; however, the buyer must recognize that the reports are based on inspections conducted at a specific time and cannot cover all intricate details or guarantee the absence of future problems.

6. Limitations of Liability:

The provided reports are for informational purposes only. We are not responsible for any losses or damages that may arise from purchase decisions based on these reports. It is always recommended to verify the vehicle's condition personally or by requesting an additional inspection (comprehensive inspection of all vehicle parts).

7. Return and Exchange Policy:

Due to the nature of the service we provide, inspection reports for auction vehicles cannot be returned or exchanged after purchase. All purchases are final, and the buyer is not entitled to request a refund.

8. Report Delivery:

Auction vehicle inspection reports are delivered electronically via email or WhatsApp after the purchase process is completed. Ensure that the email address or mobile number is entered correctly at purchase to avoid any delays in receiving the report.

9. Availability and Pricing:

Inspection report prices may vary based on the type and condition of the vehicle to be inspected. We reserve the right to adjust prices at any time without prior notice.

10. Confidentiality of Information:

All information provided in the inspection reports is confidential and intended solely for the buyer. The buyer is not entitled to distribute or sell this information to any third party.

11. Terms and Conditions:

By purchasing an auction vehicle inspection report, you agree to all the above terms and conditions. We recommend reading this policy carefully before completing the purchase.



Disclaimer

1. Legal and Regulatory Liability Waiver:

We, CarTech Vehicle Services Company (CarTech), waive any legal or regulatory liability arising from this inspection. We do not bear any responsibility or damage claims related to this report and are in no way liable for any loss or damage of any kind that may be incurred due to this report. We fully disclaim our liability.

2. Condition-Based Inspection:

The Customer (buyer) understands that the report and inspection are based on a specific condition of the vehicle, a specific time, and date during the inspection under certain conditions. Therefore, there is no guarantee or liability for changes in the vehicle's time or conditions, and we are not responsible for that.

3. Electronic Information Basis:

The Customer (buyer) understands that the report is based on information issued by electronic devices and software and that this information was retrieved based on device results.

4. Invisible Defects:

The service and any information or latent defects not appearing in the current condition are outside our responsibility limits, and we do not bear them at all. CarTech is not responsible for any loss resulting from any inaccurate information provided by the Second Party regarding the vehicle to be inspected.

5. No Responsibility for Vehicle Condition Changes:

We have no responsibility whatsoever for the vehicle's condition before or after the inspection date.

6. Inspection Service Description:

The inspection service only identifies defects found in the vehicle during the inspection period and included in the report covered by the inspection. Future malfunctions are not speculated or guaranteed, and we are not responsible for them.

This authority is exclusive and complete for CarTech. Continued use of any service by the client or any party constitutes full acceptance of any amendments, additions, or deletions. The client is solely responsible for reviewing and staying informed of any updates, without claims of lack of knowledge, fraud, unfairness, or ignorance, and without any liability on CarTech. The updated terms apply to the client accordingly.
